Terms of Service
Trimmr LLC, a California limited liability company ("Trimmr," "we," "us," or "our"), operates the Trimmr mobile application and related services (the "Service"). These Terms of Service (the "Terms") govern your access to and use of the Service. Questions may be directed to support@trimmr-app.com.
1. Acceptance of These Terms
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
If you use the Service on behalf of a business, such as a barbershop, you represent that you have authority to bind that business to these Terms.
The Service is offered only to users located in the United States. It is not intended for or directed to users outside the United States. If you are located outside the United States, do not access or use the Service.
2. Definitions
- "Barber" means a barber, stylist, or shop that uses the Service to list services, accept bookings, manage business tools, and optionally accept payment.
- "Client" means a user who uses the Service to discover, book, and optionally pay a Barber.
- "User," "you," or "your" means any person who accesses or uses the Service, including Barbers and Clients.
- "User Content" means any photos, videos (including reels), audio, text, messages, reviews, or other materials a User uploads or shares through the Service.
- "Booking" means an appointment a Client reserves with a Barber through the Service.
- "Subscription Provider" means Apple, the Apple App Store, or another provider through which a Barber subscription is offered and billed.
- "Payment Processor" means Stripe or another third-party provider used to process optional Client-to-Barber payments, deposits, booking fees, refunds, disputes, and payouts.
3. The Trimmr Platform
Trimmr is a technology platform that helps Clients discover and book Barbers, and helps Barbers manage bookings, showcase their work, and use optional business and payment tools. Trimmr is not a barber, barbershop, employer, agent, or provider of grooming services.
Trimmr is not a party to the grooming-service agreement between a Barber and a Client. The actual grooming service is provided solely by the Barber. Trimmr does not control, supervise, guarantee, or take responsibility for the quality, safety, legality, licensing, availability, or outcome of any service a Barber provides, and is not liable for disputes between Users except as required by law.
4. Eligibility and Accounts
4.1 Age Requirements
Clients must be at least 13 years old to register for and use the Service. Users under 18 may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms and accepts responsibility for the minor's use, including any payments. Payment and payout features may also be subject to age, identity, account, and eligibility requirements imposed by Apple, Stripe, financial institutions, or applicable law.
4.2 Account Registration
You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly of suspected unauthorized use.
4.3 One Account Per User
You may not maintain multiple or deceptive accounts to evade plan limits, fees, trial restrictions, or enforcement actions, or to abuse free-tier features. We may verify account information and may suspend or terminate accounts that violate this section.
5. Barber Plans and Subscriptions
5.1 Plans
Trimmr offers a free Starter plan and optional paid Barber plans, including Essential and Ultimate. Current prices, billing intervals, booking limits, features, and eligibility rules are displayed in the Service before purchase and may change on a going-forward basis. Monthly and annual options may be offered where available. Eligible new Barber subscribers may receive the 14-day free trial described in Section 5.4.
5.2 Apple In-App Purchase on iOS
On iOS, paid Barber subscriptions are purchased through Apple In-App Purchase and are billed to the Apple ID used at checkout. Apple processes the subscription payment and controls billing, renewal, cancellation, refund eligibility, and related account management under Apple's terms. Trimmr does not receive or store full payment-card details for Apple In-App Purchase transactions.
5.3 Auto-Renewal, Cancellation, and Refunds
- Paid subscriptions are billed in advance and automatically renew at the billing interval shown at purchase unless cancelled.
- The renewal price and billing period are shown before purchase and may also be available in the user's platform subscription settings.
- For subscriptions purchased through Apple, cancellation is managed through the user's Apple ID subscription settings. Cancellation generally takes effect at the end of the current paid period unless Apple states otherwise.
- Subscription refunds are governed by the Subscription Provider's rules and applicable law. Trimmr cannot guarantee or directly issue refunds for purchases processed by Apple.
- If a subscription payment fails, expires, is revoked, or is cancelled, Trimmr may restrict paid features or move the account to the Starter plan when the paid entitlement ends.
5.4 14-Day Free Trial and Promotional Offers
- Eligible new Barber subscribers may receive a fourteen (14) day free trial of the paid plan selected at checkout. A valid Apple payment method may be required to begin the trial.
- Unless the subscription is cancelled at least 24 hours before the trial ends, it automatically converts to a paid subscription and Apple charges the then-current price for the selected billing interval.
- The free trial is generally limited to one trial per Apple ID and/or Trimmr account and is subject to Apple's eligibility rules. Users who previously received a free trial or introductory offer may not be eligible.
- Trial availability and eligibility are determined by Apple and are displayed on the Apple purchase sheet before confirmation. If the Apple purchase sheet does not display a free trial, the purchase will begin as a paid subscription.
- Cancellation must be managed through the user's Apple ID subscription settings. Cancelling during the trial generally preserves access until the trial expires unless Apple states otherwise.
- Trimmr does not control Apple's billing eligibility, trial eligibility, renewal processing, or refund decisions. Any future discount, introductory offer, or promotion is governed by the terms displayed at checkout.
6. Optional Client-to-Barber Payments
6.1 Optional Feature
The Service may offer an optional feature that lets a Client pay a Barber for services through the app. Use of this feature is optional for both Clients and Barbers. Barbers may also accept payment directly, for example by cash or another method, outside the Service.
6.2 No Commission on Listed Service Price; Client Booking Fee
Trimmr does not take a commission or percentage of a Barber's listed service price or tip. If a Client chooses to pay through Trimmr, Trimmr may charge the Client a separate, clearly disclosed booking fee to cover payment-processing and platform costs associated with that transaction. The booking fee is shown before confirmation, is separate from the Barber's listed service price and tip, and is not deducted from the amount designated for the Barber. If the Client chooses to pay in person, no Trimmr booking fee applies unless clearly disclosed before the transaction.
6.3 Payment Processing and Payouts
Optional in-app Client-to-Barber payments are processed through Stripe and, where applicable, Stripe Connect. Payment routing, settlement, identity verification, refunds, disputes, and payouts are subject to Stripe's terms and requirements. Barbers are responsible for providing accurate payout, identity, banking, and tax information and for maintaining any Stripe-required account status necessary to receive payouts.
6.4 Taxes
Barbers are solely responsible for determining, collecting, reporting, and remitting taxes associated with their services and earnings. Trimmr does not provide tax advice. Stripe or another provider may issue tax forms where required by law.
7. Tips
Where tipping is available through the Service, tips are voluntary and are designated for the Barber. Trimmr does not take a percentage of tips. A separately disclosed Client booking fee may reflect payment-processing costs attributable to the total in-app transaction, including a tip, but the tip itself is not treated as a Trimmr commission. Tips are non-refundable except where required by law, the transaction terms, or the Barber's discretion.
8. Deposits, Cancellations, and No-Shows
8.1 Booking-Specific Policies
The deposit, cancellation, refund, and no-show terms displayed to the Client before confirming a Booking govern that Booking. The available policy options may depend on the Barber's plan and settings, and the Service may preserve the accepted policy terms with the Booking even if the Barber later changes settings.
8.2 Processing and Limitations
- A timely Client cancellation may result in a refund when required by the disclosed policy.
- A late cancellation or no-show may result in retention or processing of an eligible amount only when authorized by the disclosed policy and supported by the active payment feature.
- If a Barber cancels a Booking, amounts paid in-app for that Booking will be refunded as required by the transaction terms and applicable law.
- Trimmr does not automatically charge unpaid balances unless the checkout flow and accepted policy expressly authorize that charge.
- For payments arranged outside Trimmr, Users are responsible for handling deposits, cancellations, no-show charges, and refunds directly.
9. Refunds
Refunds required by a Booking's disclosed policy or by applicable law will be handled according to the transaction terms and available payment functionality. Refund requests based on service quality or other matters outside the disclosed cancellation policy are generally between the Client and Barber. Trimmr may provide tools or support but does not guarantee or adjudicate service-quality refunds.
Any refund of a Client booking fee will be determined by the terms shown at checkout, the applicable Booking policy, Stripe's processing rules, and the circumstances of the transaction. Subscription refunds are governed by Section 5.3.
10. Chargebacks and Payment Disputes
For transactions processed through the Service, chargebacks, reversals, disputes, and related fees are subject to Payment Processor rules, applicable law, and transaction-specific terms. Except where a dispute results solely from Trimmr's own billing or technical error, a Barber may be financially responsible for chargebacks, reversals, or fees arising from the Barber's services, including alleged non-performance, service-quality complaints, cancellations, no-shows, fraud, misrepresentation, or policy violations.
To the extent permitted by law and Payment Processor rules, a Barber authorizes Trimmr and the Payment Processor to withhold, reverse, offset, deduct, or recover disputed amounts and associated fees from transfers, payouts, connected-account balances, future earnings, or other amounts owed to the Barber. Trimmr may pause transfers or payment features while a dispute or recovery remains unresolved.
Trimmr may investigate disputes and submit relevant Booking, transaction, account, service, and communications information to Stripe, financial institutions, or card networks. The Payment Processor, card network, or financial institution ultimately determines the outcome of a payment dispute. Trimmr is not responsible for disputes involving payments made outside the Service.
11. User Content and Reels
11.1 Your Responsibility
You are solely responsible for User Content you upload, including reels and any music or audio they contain. You represent and warrant that you own the content or have all rights, licenses, and permissions necessary to upload it and grant the license below, and that it does not violate law or any third party's intellectual-property, privacy, publicity, contractual, or other rights.
11.2 Music and Third-Party Audio
You are responsible for obtaining rights to music, audio, and other third-party material included in User Content. Trimmr may offer licensed or royalty-free tracks for use within the Service, but does not grant rights to third-party music. Trimmr may mute, restrict, remove, or disable content it believes may infringe another party's rights.
11.3 License to Trimmr
You retain ownership of your User Content. By making it available, you grant Trimmr a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, perform, distribute, and otherwise use that User Content for the purpose of operating, providing, promoting, and improving the Service. This license ends when you delete the User Content, except where it has been shared with others who have not deleted it or retention is required by law.
11.4 Removal
Trimmr may remove, disable, mute, or restrict User Content at its discretion, including content it believes violates these Terms or another party's rights. Trimmr is not obligated to host any particular User Content.
12. Copyright and DMCA
Trimmr respects intellectual-property rights and responds to valid notices of alleged copyright infringement under the Digital Millennium Copyright Act. Notices may be sent to support@trimmr-app.com and should identify the copyrighted work, the allegedly infringing material, the complaining party's contact information, a good-faith statement, an accuracy-and-authority statement under penalty of perjury, and a physical or electronic signature. Repeat infringers may have their accounts terminated.
13. Prohibited Conduct
- Violate any law or these Terms, or infringe anyone's rights;
- Upload content that is unlawful, infringing, harassing, hateful, sexually explicit, harmful, or that you lack rights to;
- Create multiple or fake accounts, or evade plan limits, fees, promotional restrictions, or enforcement;
- Use the Service to defraud anyone, launder money, or facilitate prohibited transactions;
- Interfere with, disrupt, scrape, reverse engineer, or attempt to gain unauthorized access to the Service;
- Engage in fraud, deception, or abuse to evade fees on a transaction the User has chosen to process through Trimmr. This does not prohibit selecting a Pay in Person option that Trimmr expressly offers.
14. Relationship Between Barbers and Clients
Barbers are independent businesses, not employees, agents, or partners of Trimmr. Trimmr does not employ Barbers, set their prices or service standards, or guarantee any volume of Bookings. Any agreement for grooming services is solely between the Barber and Client. Trimmr is not responsible for the acts or omissions of any Barber or Client.
15. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TRIMMR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY BOOKING OR SERVICE WILL MEET YOUR EXPECTATIONS. TRIMMR DISCLAIMS RESPONSIBILITY FOR THE QUALITY, SAFETY, LEGALITY, LICENSING, OR OUTCOME OF SERVICES PROVIDED BY BARBERS AND FOR USER CONTENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TRIMMR AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE. TO THE FULLEST EXTENT PERMITTED BY LAW, TRIMMR'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID DIRECTLY TO TRIMMR IN THE SIX MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
17. Indemnification
You agree to indemnify, defend, and hold harmless Trimmr LLC and its members, officers, employees, and agents from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your use of the Service; (b) your User Content or use of music or third-party materials; (c) any service you provide or receive; (d) your violation of these Terms or law; or (e) your violation of another party's rights.
18. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. If we make material changes, we will provide notice through a channel reasonably available for the Service, such as an in-app notice, an updated effective date, or email where appropriate. Changes apply on a going-forward basis from the stated effective date. Your continued use after changes take effect constitutes acceptance to the extent permitted by law. Prices, billing intervals, and plan features may change prospectively.
19. Suspension and Termination
We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, create risk or legal exposure, fail payment or eligibility requirements, or for another reason permitted by law. You may stop using the Service at any time. Sections that by their nature should survive termination, including payment obligations, disclaimers, limitation of liability, indemnification, and dispute provisions, will survive.
20. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. The state and federal courts located in Sacramento County, California will have exclusive jurisdiction over disputes arising out of or related to these Terms or the Service, and you consent to their personal jurisdiction, except where applicable law requires otherwise.
21. General
- Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Trimmr regarding the Service, together with transaction-specific terms displayed at checkout.
- Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
- No Waiver. Failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, financing, reorganization, or sale of assets.
- Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
